These terms and conditions of sale are agreed between, on the one hand, ASSOCIATION APACHE PRODUCTION, whose registered office is located at 16 rue Roger Halopé – 49000 Angers – France, and, on the other hand, any individual or legal entity wishing to make a purchase via the Tomawok website.

Purpose
These terms and conditions of sale are intended to define the contractual relationship between ASSOCIATION APACHE PRODUCTION and the buyer, and the conditions applicable to any purchase made through the Tomawok e-commerce website, whether the buyer is a professional or a consumer. The purchase of a good or service through this website implies the buyer’s unreserved acceptance of these terms and conditions of sale.
Modification of the Terms and Conditions of Sale
ASSOCIATION APACHE PRODUCTION reserves the right to modify its terms and conditions of sale at any time. The applicable terms and conditions will be those in force on the date of the buyer’s order.

Prices
The prices listed in the catalogue are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order. ASSOCIATION APACHE PRODUCTION reserves the right to modify its prices at any time.
Orders
Buyers on the Tomawok e-commerce site must complete the online order form, confirm their order after checking it, make payment in accordance with the terms and conditions, and confirm their order and payment. Confirmation of the order implies acceptance of these terms and conditions of sale.
Withdrawal
Buyers who are non-professional individuals have a withdrawal period of 14 days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.
Payment Terms
Payment is due upon ordering. Payments shall be made by credit card via a credit card payment module using SSL protocol. The purchaser’s account shall be debited upon confirmation of the order.
Deliveries
Deliveries are made to the address indicated on the order form. The risks are borne by the buyer from the moment the products leave the premises of ASSOCIATION APACHE PRODUCTION. Delivery times are given for information purposes only.
Warranty
All products supplied by ASSOCIATION APACHE PRODUCTION are covered by the legal warranty. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or refund it, within thirty (30) days of the date of delivery of the order.

Liability

The APACHE PRODUCTION ASSOCIATION will archive purchase orders and invoices on a reliable and durable medium in accordance with the provisions of Article 1348 of the Civil Code. The computerised records of the APACHE PRODUCTION ASSOCIATION will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Settlement of Disputes
In the event of a dispute, jurisdiction is assigned to the competent courts of Paris, notwithstanding multiple defendants or the introduction of third parties.
